1. Acceptance of Terms

By accessing or using Kavivero ("the Service"), operated by Smart Technology Investments LLC, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of the Service immediately. Continued use after modifications to these terms constitutes acceptance of the updated terms.

2. Description of Service

Kavivero provides mortgage refinance timing optimization tools, including break-even analysis, rate trajectory modeling, cash-out equity calculations, ARM-to-fixed conversion NPV projections, and PMI removal timing estimates. Kavivero is not a mortgage lender, broker, or financial advisor. All refinance projections and rate estimates are for informational purposes only and do not constitute lending offers, rate locks, or financial advice.

3. Acceptable Use

You agree to use Kavivero solely for lawful personal mortgage analysis. You shall not scrape, reverse-engineer, or redistribute rate data or refinance models obtained from the Service. Automated access without a valid API subscription is prohibited. You may not use the Service to generate misleading loan qualification documents or misrepresent refinance eligibility.

4. Intellectual Property

All algorithms, rate trajectory models, break-even calculators, and refinance optimization engines are the proprietary intellectual property of Smart Technology Investments LLC. Your use of the Service grants no ownership rights to the underlying computation models, rate data, or software. Generated PDF reports are licensed for your personal use only.

5. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Smart Technology Investments LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of refinance estimates, including but not limited to losses from refinancing decisions, rate changes, closing cost miscalculations, or decisions made in reliance on Service output. Our total liability shall not exceed the amount paid for the Service in the twelve months preceding the claim.

6. Disclaimers

Mortgage rates change daily based on market conditions, lender policies, and borrower qualifications. Kavivero estimates are derived from aggregated rate survey data and may not reflect actual rates available to you. Break-even calculations assume stable rate environments and may not account for prepayment penalties or specific lender fees. Users should obtain actual loan estimates from licensed mortgage lenders before making refinancing decisions.

7. Dispute Resolution and Arbitration

Any dispute arising from your use of Kavivero shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Los Angeles County, California. You waive any right to participate in a class action lawsuit or class-wide arbitration against Smart Technology Investments LLC.
